In no event shall we, our suppliers or licensors be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for any special, incidental or consequential damages or for the cost of procurement of substitute products or services or for interruption of use or loss or corruption of data. We shall have no liability for any failure or delay due to matters beyond our control. The Website is provided “as is” and we, our suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither We, our suppliers , agents and licensors makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted.

We further expressly declare that we have the right (though not the obligation) at our sole discretion to refuse or remove any content that, in our opinion, violates any of our policies or is in any way harmful or objectionable and that we have the right to terminate or deny access to and use of the Website by you or by any other individual or entity for any reason, in our sole discretion. We expressly reserve the right to refuse the printing of any particular photo content ordered to be printed by you at our sole discretion if it violates any of our policies, is harmful or objectionable and/or constitutes immoral or illegal content and which may be against public policy.

You agree and acknowledge that this website may experience unexpected technological problems or errors in the operation of the website which may cause delays in the processing of orders submitted by you through this website and we expressly declare that we are not liable for any such delays.
By uploading the photo content you represent and warrant that the downloading, copying and use of the said photo content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secrets of any third party and/or that you have fully complied with any third-party licenses relating to the photo content, and have done all things necessary to successfully pass through to end users any required terms and the photo content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content; the photo content is not spam, is not machine or randomly-generated, and does not contain unethical, pornographic, libelous or defamatory content and your identity is not named in a manner that misleads us into thinking that you are another person or company.

You further agree to indemnify and holds us harmless and free from any claim or liability including all costs associated with the subscriber’s photo upload and/or the subsequent printing of the order with respect to any third party claims.
You represent and warrant that you will use of this website in strict accordance with this agreement and you agree to indemnify and hold us, our contractors, our agents, licensors, and their respective directors, officers, employees and agents harmless from and against any and all claims and expenses, including attorneys’ fees, arising out of an improper use of this Website and including but not limited to your violation of this agreement which shall be governed under the laws of Sri Lanka.

NOTE: We will only knowingly provide our products or services to persons who have the ability to lawfully enter into and form contracts under the applicable law of Sri Lanka. If you are under the age of eighteen (18), but at least thirteen (13) years of age, you may order products or services only under the supervision of a parent or legal guardian who agrees to be bound by these terms and conditions. Children under the age of thirteen (13) may view this website but may not order products or services.
